Evicting Your Tenant

For Landlords seeking to evict a tenant (s) using a Section 21 Notice, ensure that the following requirements have been followed otherwise the Notice is invalid: –

You cannot use a Section 21 notice if you have not given the tenants copies of:

  • the property’s Energy Performance Certificate
  • a current gas safety record for the property
  • the government’s ‘How to Rent’ guide

The above documents must be provided to the tenant (s) at the start of the tenancy and a checklist ticked and signed by the tenant to confirm receipt of the documents.

Where the tenant is to be evicted for failing to pay their rent, late rent payments etc, a Section 8 Notice is ideal. In that case, the tenant must be provided with full two months notice period.

It is also very important that Landlords or their agents ensure that the tenant’s rent deposit is protected at the start of the tenancy using a deposit protection scheme and a prescribed form provided to the tenant.
